The personal data of our users is stored and processed by us in compliance with relevant regulations, in particular the German Data Protection Regulation (GDPR), the German Federal Data Protection Act (BDSG) and the German Telecommunications and Digital Services Data Protection Act (TDDDG), as amended from time to time. All personal data is collected only for specified, explicit and legitimate purposes and is not kept longer than necessary.

 

Personal data

Personal data is individual information about personal or factual circumstances of an identified or identifiable natural person (e.g. name, date of birth and contact details).

 

Web pages

Our web servers temporarily save each access in a log file as soon as you visit our web pages. The following data may be collected and stored until automated deletion: IP address, date and time of access, amount of data transferred, messages about the success of the retrieval of the web pages, identification data of the browser and operating system used, the web page from which access is made and the IP address of your Internet access provider. This data is processed for the purpose of enabling use of the web pages, system security, technical administration of the network infrastructure and optimisation of the Internet offering. This is to be regarded as a legitimate interest according to Art. 6 para. 1 p. 1 lit. f GDPR.

 

Other data collection

We collect, store and process your personal data (e.g. first name, surname, address, email address, telephone number) if a business relationship exists or is to be established, e.g. within the scope of a subscription or an order, as well as regarding the content and amendment of the business relationship. In addition, we use your personal data as provided by you for registration on our website and when you have consented to processing of your personal data. Furthermore, we collect, store and process your personal data when you contact us via the contact or applicant form, or by telephone, fax or email, should it be required for processing of your enquiries and correspondence. The personal data we collect is deleted immediately as soon as it is no longer required for this purpose, unless there are legal retention periods.

Applicant portal

When you send us your application via our online applicant portal, we collect and process the personal data provided for the purpose of filling vacancies or processing your application and completing the application process. Mandatory data is indicated by an asterisk. All additional information provided is voluntary. The legal basis for mandatory data is the necessity of initiating the employment relationship pursuant to Art. 88 GDPR in conjunction with § 26 para. 1 p. 1 Federal Data Protection Act (BDSG), Art. 6 para. 1 lit. b GDPR. Should your curriculum vitae contain special categories of personal data, we process them as part of the application process for the exercise of rights or the fulfilment of obligations under labour law, social security law and social protection law. The legal basis is therefore Art. 88 GDPR in conjunction with. § 26 (3) Federal Data Protection Act (BDSG).

We store your personal data for the duration of the application process, as well as for the period in which we potentially have to expect the assertion of legal claims against us. The statutory limitation period for such claims in the context of the application process is 6 months after the end of the application process. Should an employment relationship result from your application, the retention periods for employee data apply accordingly.

We use an external service provider for operation of the online applicant portal, however this service provider may only process personal data based on our instructions. We have concluded an order processing agreement with this company pursuant to Art. 28 para. 3 GDPR.

The applicant portal provides links to share the job postings on any social network. By clicking on these links, you are accessing the website directly through the respective responsible parties, which means that our data protection provisions do not apply to that website.

 

Content embedded with iFrame

Our website contains content embedded using iFrame. This content is used to display our applicant portal. The body responsible for data protection on the applicant portal is HOFFMANN Maschinen- und Apparatebau GmbH; the technical provision of the applicant portal is carried out by a service provider commissioned by us.

 

Contact form

Should you use our contact form and send us an enquiry, the information you provide and your contact details are stored by us for the purpose of processing the enquiry and for any follow-up questions. The data is not disclosed without your consent.

The legal basis for processing the data provided in the contact form is your consent (Art. 6 para. 1 lit. a GDPR), which you have given by checking the box in the contact form. You may revoke this consent at any time without giving reasons to the above address or electronically (e.g. by email). The legality of the data processing performed until revocation remains unaffected by the revocation.

The data provided in the contact form is stored by us until your request for deletion, until receipt of the revocation or after the purpose of the data storage has ceased to exist (e.g. when processing of the request has been completed). This has no effect on statutory provisions, especially regarding the retention periods.

 

Transfer of data

We use your personal data within Hoffmann Maschinen- und Apparatebau GmbH and our affiliated companies. These companies, as well as our external service providers who perform data processing on our behalf, are contractually obliged in the context of Art. 28 GDPR to handle the personal data in accordance with applicable regulations. Should these companies come into contact with your personal data, we have ensured through legal, technical and organisational measures, as well as through regular checks, that they comply with the provisions of data protection laws.

Should you find links from other controllers on our website (e.g. to our social media presences or our internal reporting point) and click on the link, you are accessing the website directly with the respective controllers, which means that our privacy policy does not apply to that website.

In principle, we do not transfer your personal data to third countries or international organisations outside the European Economic Area (EEA). Should we, in individual cases, effect such a transfer, this only takes place to those third countries for which an adequacy decision has been issued by the European Commission or the appropriate level of data protection has been ensured by suitable or adequate safeguards (e.g. Binding Corporate Rules or EU standard contractual clauses).

We reserve the right to transfer your personal data to authorities entitled to receive such information when obligated to do so by law or by court order.

As a matter of principle, your personal data is not transferred to other third parties.

 

Whistleblower system

Our website provides access to a reporting channel with which you can file a report to our internal reporting point in line with the Whistleblower Protection Act (HinSchG). We have tasked a service provider with the technical provision of the reporting channel and the operation of the internal reporting point. If you use the reporting channel, you are using a whistleblower system of LegalTegrity GmbH. This is the body responsible under data protection law for the receipt of the report, which means that our data protection provisions do not apply here. We may gain knowledge of reports through our internal reporting point when performing its tasks. Should we come into contact with your personal data in this process, we have ensured through legal, technical and organisational measures that they comply with the provisions of data protection laws.

HTML5 storage objects

We use HTML5 storage objects on our website, which are stored on your terminal device. The data required is stored regardless of the browser used. There is no expiration date. Processing of the HTML5 storage objects is prevented by using private mode in the browser in use.

Analysis of websites

To optimise the content and offerings on our website and collect statistical analysis, various technical programs are used which record data about the behaviour of the website’s users in anonymised form. For this purpose, data on things such as click behaviour, visit duration, system settings and user origin are collected in the form of text files through the use of analysis software cookies. Cookies are stored on your computer for these analyses. This collected data may be saved on the servers of the operators of the analysis tool. The collected data is not used for the personal identification of the user or amalgamated with other personal data of the user.

Google Analytics

Google Analytics is used on our website provided you have declared your consent in the notice on cookies. This is a web analysis service of Google Inc. Therefore, the legal basis for the use of Google Analytics is your consent in line with Art. 6 para. 1 sentence 1 lit. a GDPR. and § 25 para. 1 TDDDG.

Google Analytics uses cookies which are saved on your computer and enable the analysis of your use of our website. The information generated by the cookie about your use of this website is usually sent to a Google server in the USA and stored there.

We also use the Google remarketing function. This involves the creation of remarketing target groups based on user behaviour on our website, which are then used as the basis for remarketing campaigns in other accounts such as Google Ads and Display & Video 360. If your behaviour meets the criteria set by us beforehand, the relevant cookie or advertising ID of your device is added the corresponding target group. If you then subsequently access other websites in the Google display network or use the Google search, one of our remarketing advertisements can be presented to you.

Our website uses Google Analytics with the extension “_anonymizeIp”. This is used to further process IP addresses in truncated form to prevent personal identification. If the data collected about you includes a reference to your person, this will be excluded immediately and the personal data will be deleted immediately. In exceptional cases, the full IP address is sent to a Google server in the USA and truncated there. The IP address transmitted by your browser in the context of Google Analytics will not be amalgamated with other Google data.

On our behalf, Google will use this data to analyse your use of the website, to compile reports about website activity, and to provide us with other services associated with the use of the website and the Internet.

This data will be deleted automatically after 14 months. Data whose retention period is complete is deleted automatically once per month.

If you do not want Google Analytics to collect your data, you can set this in the cookie layer.

In connection with the use of Google Analytics, we also use the Google signals service. This is a Google Analytics function which allows us to collect not only your IP address, but also additional information, such as your location, age and income, when you access our website. The data collected upon a visit to our website is linked with your Google account. This allows your user behaviour to be tracked across multiple devices even upon one visit. Only if you have enabled personalised advertising in your Google account will your user data stored by Google be shared with us in summarised, anonymised form. This allows us to create user groups and have more precisely targeted ads displayed to you. The use of Google signals means that we cannot identify you as an individual. The transmitted user data is deleted after 26 months as standard.

YouTube

YouTube plug-ins on our web pages are operated by YouTube, LLC., 901 Cherry Ave, San Bruno, CA 94066, USA. YouTube plug-ins are identified by the YouTube logo. In the USA, other data protection provisions apply which provide more access rights to personal data, for example by the US authorities. As soon as you use such a plug-in, your browser establishes direct contact with YouTube, causing your information to be transmitted directly to a YouTube server. When you are logged into YouTube at the same time as your visit to our website, YouTube is able to directly associate your visit with your account. When leaving a comment or pressing the YouTube button, this information is also transmitted to a YouTube server and stored by YouTube in the USA. In addition, your YouTube interactions are published directly on YouTube and may therefore be visible to third parties. Should you not wish to interact in this way, you must log out of YouTube before visiting our website and also prevent the YouTube plug-ins from loading on our site by using a script blocker.
