We store and process our users’ personal data in accordance with the relevant regulations, in particular the General Data Protection Regulation (GDPR), the Federal Data Protection Act (BDSG) and the Act on Data Protection and the Protection of Privacy in Telecommunications and Digital Services (TDDDG), in their current versions. All personal data is collected only for specified, explicit and legitimate purposes and stored no longer than necessary. 

Personal data 

Personal data refers to specific details concerning the personal or factual circumstances of an identified or identifiable natural person (e.g. name, date of birth and contact details). 

Website

As soon as you visit our website, our web servers temporarily store each access in a log file. The following data may be recorded and stored up to automatic deletion: IP address, date and time of access, amount of data transferred, reports on the success of the access of the website, identification data of the browser and operating system used, the website from which the access takes place, and the IP address of your Internet access provider, among others. The processing of this data takes place for the purpose of enabling the use of the website, for system security, for technical administration of the network infrastructure, and the optimization of the internet offer. This is to be regarded as a legitimate interest within the meaning of Art. 6 para 1 lit f GDPR. 

Other Data Collection

We collect, store and process your personal data (e.g. first name, name, address, email address, telephone number) insofar as a business relationship exists or is to be established, e.g. as part of a subscription or an order, as well as in course of the content design and modification of the business relationship. We furthermore use your personal data where you have submitted it to us for the registration on our website and have consented to the processing of your personal data. Furthermore, we collect, store and process your personal data if you approach us via phone or fax, applicant or contact forms as well as by sending an email, to the extent that this is necessary for processing your inquiries and correspondence. The personal data collected by us will be immediately deleted once they are no longer required for this purpose, unless legal retention periods apply. 

Applicant portal

As soon as you submit your application via our online application portal, we will collect and process the personal data you provide for the purpose of filling vacant positions and/or processing your application and conducting the recruitment process. The required details are marked with an asterisk to indicate that they are mandatory fields. Any further information is optional. The legal basis for the mandatory information is the necessity arising from the prospective employment relationship, in accordance with Art. 88 GDPR in conjunction with Section 26 para 1 sentence 1 of the BDSG and Art. 6 para 1 lit b GDPR. If your CV contains special categories of personal data, we will process these as part of the recruitment process for the purpose of exercising rights or fulfilling obligations under employment law, social security law and social protection law. The legal basis is therefore Art. 88 GDPR in conjunction with Section 26 para 3 of the Federal Social Court Act.

We will retain your personal data for the duration of the application process, as well as for the period during which we may reasonably expect legal claims to be brought against us. The statutory limitation period for such claims in the context of the application process is 6 months from the end of the application process. Should your application result in an employment relationship, the retention periods for employee data will apply accordingly.

We use an external service provider to host the online application portal; however, this provider is only permitted to process personal data in accordance with our instructions. We have entered into a data processing agreement with them in accordance with Art. 28 para 3 GDPR.

On the applicant portal, you will find links to share the job vacancies on social media platforms. If you click on these links, you will be taken directly to the respective websites, on which our privacy policy does not apply.

Embedding content via iFrame

Additional content is embedded on our website via iFrame. This content provides an overview of our applicant portal. The data controller for the applicant portal is HOFFMANN Maschinen- und Apparatebau GmbH; the technical provision of the applicant portal is handled by a service provider commissioned by us. 

Contact form

If you use our contact form to send us an enquiry, the information provided in the form, along with your contact details, will be stored by us for the purpose of processing your enquiry and for any follow-up questions. Your data will not be shared without your consent. 

The legal basis for processing the data provided in the contact form is your consent (Art. 6 para 1 lit a GDPR), which you gave by ticking the box in the contact form. You may withdraw this consent at any time without giving any reason by writing to the address above or electronically (e.g. by email). The lawfulness of any data processing carried out prior to the withdrawal remains unaffected by the withdrawal. 

The data provided in the contact form will be retained by us until you request its deletion, until we receive your withdrawal of consent, or until the purpose for which the data was stored no longer applies (e.g. once your enquiry has been fully processed). This does not affect the statutory provisions, in particular the retention periods. 

Transfer of Data

We use your personal data within the HOFFMANN Maschinen- und Apparatebau GmbH and our affiliated companies. These companies, as well as our external service providers who process data on our behalf, are contractually obliged under Art. 28 GDPR to handle personal data in accordance with the applicable regulations. To the extent these companies come into contact with your personal data, we have taken legal, technical and organizational measures and perform regular checks to ensure that they comply with the regulations of the data protection laws. 

If you find links from other data controllers on our website (e.g. to our social media pages or to our internal reporting channel) and click on such link, you will be accessing the website directly via the respective data controller, with the result that our privacy policy does not apply to that website.

As a general rule, we do not transfer your personal data to a third country or to an international organisation outside the European Economic Area (EEA). Should we undertake such a transfer in individual cases, this will only take place to third countries for which the European Commission has issued an adequacy decision or where an adequate level of data protection has been ensured through appropriate or adequate safeguards (e.g. Binding Corporate Rules or EU Standard Contractual Clauses).

We reserve the right to transfer your personal data to authorized bodies if we are obliged to do so by law or by court order.

A transfer of your personal data to other third parties does not take place as a matter of principle.

Whistleblower System

On our website, you can access a reporting channel and use it to submit a report to our internal reporting office in accordance with the Whistleblower Protection Act (HinSchG). We have entrusted a service provider with the technical provision of the reporting channel and the operation of the internal reporting office. When you use the reporting channel, you are using a whistleblowing system provided by LegalTegrity GmbH. This is the body responsible for receiving the notification under data protection law, with the result that our privacy policy does not apply in this case. Where applicable, we may receive reports through our internal reporting office in the course of its duties. To the extent that we handle personal data in the course of our work, we have taken legal, technical and organisational measures to ensure compliance with data protection legislation.

Cookies

On our website, various information is stored in so-called cookies which serve as a user-friendly handling of the application and make our Internet offer more effective overall. In addition, the data stored in a cookie saves repeatedly filling out forms. The cookies we use are temporary and will be deleted regularly.

Website Analysis

In order to optimize the content and offers of our website as well as to collect statistical evaluations, various technical programmes are used which record data on the behaviour of the user of the website also in an anonymised format. For this purpose, e.g. data on click behaviour, visit duration, system settings and user origin are collected by means of analysis software cookies in the form of text files. Cookies are stored on your computer for these evaluations. This collected data may be stored on the servers of the operators of the analysis tools. The data collected will not be used to personally identify the user and not be merged with other personal data of the user.

Google Analytics 

Provided that you have given your consent in the cookie notice, Google Analytics is used on our website. This is a web analytics service provided by Google Inc. The legal basis for the use of Google Analytics is therefore your consent in accordance with Art. 6 para 1 lit a GDPR and Section 25 para 1 TDDDG.

Google Analytics uses so-called “cookies”, which are stored on your computer and which allow an analysis of the use of our website by you. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there.

We also use Google’s remarketing feature. In doing so, so-called remarketing audiences are created based on user behaviour on our website and are then used as the basis for remarketing campaigns in other accounts, such as Google Ads and Display & Video 360. If your behaviour meets the criteria we have previously defined, the relevant cookie or your device’s advertising ID will be added to the relevant target group. If you later visit other websites on the Google Display Network or use Google Search, you may be shown one of our remarketing ads.

Our website uses Google Analytics with the “_anonymizeIp” extension. As a result, IP addresses are processed in truncated form, thereby ruling out any possibility of personal identification. Where the data collected about you relates to an individual, such a link will be immediately excluded and the personal data will therefore be deleted without delay. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. The IP address transmitted by your browser as part of Google Analytics will not be combined with any other data held by Google. 

Google will use this information on our behalf to analyse your use of the website, to compile reports on website activity, and to provide us with other services relating to website and internet usage. 

The data described will be automatically deleted after 14 months. Data that has reached the end of its retention period is automatically deleted once a month. 

If you do not want Google Analytics to collect data, you can adjust this setting in the cookie layer. 

We also use the Google Signals service as part of our use of Google Analytics. This is a Google Analytics feature that allows us to collect additional information (e.g. location, age, income) alongside your IP address when you visit our website. The data collected when you visit our website is linked to your Google account. This allows us to track your browsing behaviour even when you access our site from multiple devices. Only if you have enabled personalised advertising in your Google account will your user data stored with Google be shared with us in aggregated, anonymised form. This allows us to create user groups and show you more targeted advertising. We cannot use Google Signals to identify you as an individual. By default, the user data provided is deleted after 26 months.
